“After a dynamic 2024 for private equity, marked by a rebound in transactions and a strong comeback for LBOs, the outlook for 2025 is encouraging. The mid-market should see a recovery in inflows, supported by lower interest rates and geopolitical stability. Exits, although held back by unliquidated investments, are showing signs of recovery, while GP-led transactions continue to grow, with strong demand for continuation funds.”

Düsseldorf/Frankfurt, February 19, 2025 – McDermott Will & Emery has advised Helaba Landesbank Hessen-Thüringen on the conclusion of a long-term green lease agreement with Commerzbank AG for the landmark Central Business Tower project in Frankfurt’s banking district.

Commerzbank AG is renting more than 73,000 square meters in the Central Business Tower, including the entire office space in the 205-meter office tower. The lease commences upon completion of the tower in early 2028 and will run for 15 years.

The Central Business Tower consists of the 52-storey office tower (The Tower) and a five-level underground car park, complemented by a base building incorporating the listed façade and the rotunda foyer of the historic bank building dating from 1891 (The Bank). In addition to the office space for Commerzbank AG, public areas such as a restaurant, a café and a branch of the Weltkulturen Museum will be created on a gross floor area of around 115,000 square meters. The project is aiming for a platinum LEED certificate and a ‘Sustainable Construction Site’ certification from the German Sustainable Building Council.

The McDermott team was led by partner Thomas Beisken and comprised partners Pierre-André Brandt, Florian Schiefer and Frank Müller as well as associates Julia Külzer, Michael Spirk and Philip Uecker.

Schulte Roth and Zabel of counsel Michael L. Cook’s article titled “Inconvenient Bankruptcy Appeals” was recently published on the Harvard Law School Bankruptcy Roundtable.  In this piece, Michael explores how some district courts and bankruptcy appellate panels (“BAPs”) abuse their discretion when declining to review nonfinal bankruptcy court orders.

Too many district courts and BAPs have been refusing to review non-final (i.e., interlocutory) bankruptcy court orders for questionable reasons, according to this article by an experienced business bankruptcy litigator.  These courts, though, have the requisite jurisdiction under 28 U.S.C. §158(a)(3) and (b) (“…jurisdiction … with leave of the court, from interlocutory orders ….”).  Some courts for example, claim to lack discretion to review “certain interlocutory orders.”  They have devised a test for their discretion that effectively makes their review a matter of their own convenience.
