International law firm McDermott Will & Emery represented Destillers United Group S.L. (DUG), a Spanish company, together with certain of its affiliates including in the United States, Panama, Venezuela and Portugal, in the sale of its award-winning super premium Diplomático Rum brand and related assets to Brown-Forman Corporation, the publicly traded international spirits company best known for its Jack Daniels whiskey. McDermott Represents CoServ Electric in Brazos Electric’s Chapter 11 Case

    PRESS RELEASE

McDermott Represents CoServ Electric in Brazos Electric’s Chapter 11 Case

    January 20, 2023

    Read time: 3 min

International law firm McDermott Will & Emery represented CoServ Electric, the largest of the 16 member cooperatives of Brazos Electric Power Cooperative, Inc., the oldest and largest generation and transmission power cooperative in Texas.

Brazos filed for Chapter 11 on March 1, 2021 in the aftermath of Winter Storm Uri, a catastrophic winter storm that blanketed the State of Texas during the week of February 13, 2021. Shortly thereafter, Brazos received invoices totaling over $2 billion from the Electric Reliability Council of Texas (ERCOT) in connection with electrical power Brazos purchased in the ERCOT market during Winter Storm Uri.

After nearly two years, Brazos emerged from Chapter 11 on December 15, 2022. CoServ Electric was an active participant throughout Brazos’ Chapter 11 case and related, contentious litigation, including litigation initiated by Brazos against ERCOT, and litigation initiated by the unsecured creditors committee and Brazos against CoServ Electric. CoServ Electric’s active participation in Brazos’ Chapter 11 case helped achieve several critical goals, which will also benefit the other member cooperatives.

The McDermott team was led by Chuck Gibbs and Maris Kandestin and included Eric Seitz, Shelby Perry, Rob Lamkin, Eli Berman, Ted Alexander, Kelly Shami and Himanshu Patel.

    PRESS RELEASE

McDermott Represents the City of Rock Hill, South Carolina in Chapter 11 Case of GT Real Estate Holdings, LLC

    January 20, 2023

    Read time: 3 min

International law firm McDermott Will & Emery represented the City of Rock Hill, South Carolina in the Chapter 11 case of GT Real Estate Holdings, LLC (GTRE), a subsidiary of Tepper Sports Holding, Inc.

The Chapter 11 case centered around the failed project to develop a mixed-use, pedestrian-friendly community, which was to be anchored by a new headquarters and practice facility for the Carolina Panthers. GTRE acquired land in Rock Hill for the project but halted construction on the project halfway through its completion and shortly thereafter, filed for Chapter 11.

Rock Hill was one of the largest creditors in GTRE’s Chapter 11 case and had a significant interest in the development and disposition of the project site and removal of the partially constructed practice facility. Following months of contentious litigation and negotiations between Rock Hill and GTRE and its affiliates, Rock Hill successfully obtained possession of, and control over, the project site. GTRE’s Chapter  11 plan went effective on December 20, 2022.

The McDermott team was led by Chuck Gibbs and Maris Kandestin and included Eric Seitz, Shelby Perry, Grayson Williams, Sean Hennessy, Mark Meredith, Debbie Green, Chris Whalen, Brigid McCarthy, Kelly Shami and Erica Lang.
