“Mark and Sunay are exceptional lawyers with high-profile restructuring experience that will enhance our comprehensive offering to clients. Mark has an outstanding reputation in the market with a particular strength in dealing with multi-faceted group collapses and insolvency issues of an international and cross-jurisdictional nature. Mark and Sunay’s arrival, along with the recent appointments of Ranajoy Basu, Mark Fine and Aymen Mahmoud, demonstrates the Firm’s commitment to building a leading finance and restructuring capability in London. In addition, these latest appointments will work closely with colleagues in our other transactional teams (including private equity and funds teams) while expanding the breadth of our European restructuring groups across the region,” said Hamid Yunis, Managing Partner of the Firm’s London office.

“Mark and Sunay are high-calibre attorneys who fit in well and will work in close coordination with our restructuring practice Firmwide, including on cross-border matters. On a macroeconomic level, the ongoing pandemic continues to create a need for bankruptcy and restructuring expertise globally,” said Felicia Perlman and Timothy W. Walsh, Global Co-Heads of Restructuring & Insolvency.

“The Firm’s ambition, coupled with its broad international platform and the ‘one-stop service’ it offers, were major factors attracting me to McDermott,” said Mark Fennessy. “I look forward to playing a leading role in developing McDermott’s UK restructuring and insolvency offering working alongside the existing finance team in London and my international colleagues across Europe and in the US. In addition, with a focus on funds and private equity, I am excited to build on the synergies with these groups and expand our client base further. Additionally, we expect an increase in the contentious nature of restructurings and it is key that there is a strong European and US litigation presence we can work alongside,” he added, “I am delighted to be joining McDermott and look forward to working with colleagues in the finance and corporate teams in London and around the globe. I believe McDermott will provide a fantastic platform to develop further our client base internationally,” said Sunay Radia.

Both join from Proskauer Rose LLP where Mark was European Head of Restructuring and Insolvency.

    Building on momentum in London
“We have been experiencing increasing client demand across our London practices, and we continue to invest in Corporate, Private Equity, Healthcare & Life Sciences, Infrastructure, Private Client and Litigation. This has resulted in recent high-calibre appointments, including Andrea Best, Tom Whelan, Ranajoy Basu, Anthony Fine, Mark Fine and Aymen Mahmoud, and we will invest further in building on our strengths, and adapt our offering, as our clients’ needs evolve,” added Hamid.

Andrew is an esteemed advisor in antitrust issues and regularly represents Korean and Japanese electronics, engineering and shipping clients facing high-profile antitrust activity enforcements. He is highly respected globally for his work in cartel defense and merger review proceedings for international corporations based in Asia.

“Andrew is a recognized leader in the international antitrust sphere and has a deep understanding of Asia-Pacific-based clients’ global needs,” Ray Jacobsen, global head of McDermott’s Antitrust Practice, said. “His leadership role in high-profile antitrust cases is often a catalyst to additional counsel outside of his core practice, providing cross-practice collaboration opportunities. As a trusted strategic advisor, clients around the world will benefit from his business acumen and legal prowess.”

Before moving to the private sector, Andrew started his career at the US Federal Trade Commission where he initiated several high-profile antitrust enforcement actions and broadly assisted the Commission’s leadership in formulating competition law enforcement policies. His practice now focuses on the coordination of cross-border antitrust investigations and criminal enforcement matters, and particularly involves counseling international corporations based in Asia-Pacific markets.

In recent years, Andrew’s work has spanned the areas of trade secrets litigation, consumer product regulatory advice and investigations, defense of consumer civil class actions, FCC and privacy regulatory advice, international trade investigations, US government relations and policy advice, international arbitrations and biotech transactions, among others.

Andrew is the second international antritrust partner McDermott has added this month, following Hendrik Viaene joining in Brussels.

Andrew received his JD from University of California, Los Angeles School of Law and his BS from The Johns Hopkins University. Prior to joining McDermott, he was a partner at Hogan Lovells LLP.
