In a recent Fierce Network article, Carl Fleming discusses how community engagement, regulatory developments and power constraints are influencing the investment calculus for data center developers and financiers.
Drawing on his work advising clients across the energy and infrastructure sectors, including McDermott’s recent representation of Copia Power in Carlyle’s sale of the company to EQT, Carl explained that investors are conducting deeper diligence around stakeholder engagement, permitting pathways, utility coordination and political support before committing capital.
While investors may be able to absorb higher costs or shifts in market demand, they are placing greater value on projects that can demonstrate a credible path to execution. Developers with strong local relationships, coordinated infrastructure planning and greater certainty around approvals will therefore be better positioned to attract investment.
As Carl noted, “Certainty is increasingly becoming a competitive advantage in infrastructure development.”

In a recent Modern Healthcare article, Monica Wallace discusses a proposed CMS rule that would give the agency broader authority to remove providers and suppliers suspected of fraud from Medicare — and why the policy’s reach may extend well beyond bad actors.
Monica noted that the proposal could sweep in providers with no connection to any underlying fraud, such as those who share office space with a provider whose Medicare privileges were revoked, or who employ staff previously affiliated with a revoked provider.
Providers, suppliers, and their investors should understand these proposed changes and how information disclosed on enrollment records (or failed to be properly disclosed on enrollment records) could create potential adverse enrollment actions.

In a recent Pensions & Investments article, Carl Fleming discusses how AI-driven power demand is pushing private equity investment beyond data centers and into power generation, transmission and other critical infrastructure.
Using McDermott’s recent representation of Copia Power in Carlyle’s sale of Copia to EQT, Carl noted that investors are becoming more selective, focusing on projects that can realistically secure power, approvals and meet customer timelines.
He expects acquisitions, joint ventures and infrastructure partnerships to remain active as sponsors seek greater control over the infrastructure needed to support AI development.
