In observance of Veterans Day and as part of the Schulte Speaker Series, the Veterans Affinity Group welcomed James Hendon, the New York City Department of Veterans’ Services Commissioner. As a West Point graduate with higher education from Harvard Kennedy School, Columbia Business School and Earth Institute’s Program in Conservation and Environmental Sustainability, he has extensive experience in leadership, military operations and veterans’ affairs.

James previously held roles as Director of NYU’s Veterans Future Lab and various positions in the US Army, including Active Duty Infantry Officer, Admissions Officer for West Point and Senior Adviser to the Afghan Border Police. Currently, James is a drilling US Army Reservist serving as a Joint Exercise Planner for the Exercises and Coalition Affairs Directorate of US Southern Command and CEO of the Energy Economic Development Corporation, focusing on green job training in New York City. He has also contributed to energy efficiency through his past role as COO for BlocPower.

He emphasized the importance of self-identifying as a veteran and explained how to bridge the gap between veterans and the numerous services available to them. Key to aiding veterans in this self-recognition is offering support and leading with love, making it easier for them to share their experiences.

    PRESS RELEASE

McDermott Expands Renewable Energy Tax Capabilities With New Partner in Washington, DC

    November 22, 2024

    Read time: 4 min

International law firm McDermott Will & Emery welcomes Ben Cheatham to its energy & project finance practice as a partner in Washington, DC. Ben will work with clients leveraging the federal clean energy and other tax credits provided by the Inflation Reduction Act of 2022 (IRA), an area in which McDermott is leading deal activity across the industry.

“Both early-stage renewable and large traditional energy clients are seeking opportunities related to the energy transition, and we expect heightened global activity within the sector,” said Harris Siskind, global head of McDermott’s Transactions Practice Group. “Ben has extensive experience in various complex tax aspects of mega-transactions and will help clients navigate the many tax-related benefits of the IRA, such as those for solar, wind, and hydrogen projects.”

Ben focuses his practice on US federal income tax matters in the renewable and transitional energy sectors. He advises clients on the financing, development, operation, acquisition, and disposition of energy projects, with a particular emphasis on investment and production tax credits, direct pay, and credit transfer transactions under the IRA. Ben also advises on compliance with the IRA’s prevailing wage and apprenticeship requirements.

In addition to regularly representing lenders, sponsors, and borrowers as tax counsel in various transactions, Ben also has experience advising clients under audit by the Internal Revenue Service and in litigation with the US Department of Justice.

Ben started his career at first-rate AmLaw 10 law firms before moving in-house as senior director and tax counsel at Invenergy, one of the United States’ largest renewable energy developers, for the past two years. In this role, he led renewables tax planning for the company and provided strategic guidance on IRA implementation and organizational tax matters.

“Joining McDermott is an exciting opportunity and a perfect fit,” said Ben. “Having worked closely with the tax equity leads at McDermott for the last two years, I will hit the ground running and I’m confident the existing synergies will benefit clients.”

McDermott’s energy & project finance team was the first to close a post-IRA tax credit transfer in January 2023 and has since closed more than 80 post-IRA tax credit transfer driven transactions.

International law firm McDermott Will & Emery welcomes Dr. Timothy (Tim) Best as a partner in its Intellectual Property (IP) Practice Group in Los Angeles. Tim is a trial lawyer whose patent litigation work focuses on biotechnology and life sciences and spans various technological fields, including pharmaceuticals, medical devices, image processing, semiconductor manufacturing, and business methods.

“Tim’s extensive understanding of the life sciences industry and his strategic approach to complex IP issues will significantly enhance our capabilities and deepen our presence on the West Coast,” said William Gaede, head of McDermott’s global IP Practice Group.

Tim guides major pharmaceutical companies and drugmakers through all phases of high-stakes patent litigation. With extensive experience successfully defending against and asserting patent infringement claims, he has a proven track record of securing favorable rulings in complex patent disputes involving multibillion-dollar claims at trial and on appeal.

Outside of his practice, Tim teaches a course on IP litigation as an adjunct faculty member at the University of Southern California Gould School of Law. Prior to law school, while earning his PhD in chemistry, Tim focused on synthesizing DNA-binding small molecules and evaluating their activity both in vitro and in vivo using various molecular and cellular biology techniques.

“McDermott’s IP team has an acute focus on life sciences litigation that cannot be found anywhere else in the industry,” said Tim. “I’m excited to join a firm with a strong commitment to innovation and excellence, along with the subject matter experience that compliments my practice.”

Tim’s arrival comes just weeks after Michael Sitzman, another prominent life sciences patent litigator, joined McDermott in San Francisco.

The Firm’s growing IP team represents clients at every stage of the IP life cycle, with skill and experience in both the boardroom and the courtroom. Our group includes more than 100 lawyers, scientific advisors, and patent agents globally who counsel industry leaders on strategic patent and trademark portfolio development; transactions, licensing, and monetization; and enforcement and litigation. Praised by clients for our ability to “handle any type of case or technology, no matter the complexity” (Chambers), McDermott’s IP team serves companies of all sizes spanning a variety of sectors, with a focus on life sciences and technology. We are recognized globally by Chambers, Legal 500, Best Law Firms, IAM Patent 1000, Managing IP, and World Trademark Review 1000.

McDermott’s global Life Sciences Group operates as a cross-border, interdisciplinary team, drawing upon lawyers from the top-ranked healthcare law practice to work at the juncture of health, technology, and life sciences. Among the team’s recent notable work, after three years of hard-fought litigation over foundational cancer testing patents, McDermott secured back-to-back wins on behalf of Natera, a global leader in cell-free DNA testing. A Delaware jury awarded the company $19.35 million. The team has also represented an array of clients globally with respect to FDA regulatory due diligence in the context of a variety of cross-border transactions, including Life Science Outsourcing’s acquisition of J-Pac Medical.
