SRZ Speaker Series Guest Jonathan Greenblatt Shares Insights on Anti-Semitism

    February 17, 2023

    Read time: 3 min

As part of our SRZ Speaker Series, we were honored to host a special conversation with Jonathan Greenblatt, the CEO of the Anti-Defamation League (ADL). Moderated by SRZ partners David Wermuth and Julian Wise, the discussion focused on anti-Semitism, extremism and discrimination. The invaluable insights that Jonathan shared included:

    • We have to interrupt intolerance before it becomes something else.
    • Don’t eject, embrace. Follow counsel culture, not cancel culture.
    • As an ally, follow the three S’s: Speak Up (interject and interrupt intolerance), Share Facts (dial down drama) and Show Strength (play a part when it is about someone else).

SRZ has been a longstanding partner of ADL and we encourage you to read Jonathan’s book, It Could Happen Here: Why America is Tipping from Hate to the Unthinkable―and How We Can Stop It.

McDermott Comment | High Court Hands Down Good Box Restructuring Plan Judgment

    February 15, 2023

    Read time: 3 min

Mark Fine, a partner at law firm McDermott Will & Emery, said:

“The judgement handed down in Good Box continues to highlight the flexibility afforded under the Part 26A restructuring plan and builds on the momentum garnered with the likes of Houst last year in showing that the plan is available to smaller debtors who may not have sufficient funds to afford the costs often associated with a plan.

The judgment also serves to highlight some of the differences between the scheme of arrangement and the plan, through the well-publicised cross class cram down and the requirement for a company to be in financial difficulty.  It’s also noteworthy that, the plan was brought by one of the principal creditors – a deviation from the customary debtor-led plans and serves as useful precedent to any challenge that company consent to sanction the plan is required.”

    PRESS RELEASE

SRZ Releases Third Edition of Book on the Formation, Operation and Regulation of Hedge Funds

    February 9, 2023

    Read time: 3 min

Schulte Roth & Zabel today announced the release of the third edition of its comprehensive book on hedge funds, Hedge Funds: Formation, Operation and Regulation. Addressing legal and practical issues of importance to counsel for both sponsors and investors, the book explains the complete spectrum of hedge fund structuring, operation and regulation.

Since the earliest hedge funds were first established more than 60 years ago, the private funds industry has grown dramatically in size and complexity. Hedge funds now represent an entrenched investment product and a significant part of the global economy; as a result, they are also the focus of an increasing amount of regulation.

Hedge Funds covers the history of the industry, various investment strategies, structure and tax considerations, fund terms (such as fee and liquidity structures), regulatory requirements, fund documentation and fund financing, among other topics critical to a full understanding of operating a hedge fund in the present regulatory and market environment.

Offering an understanding of the legal and operational aspects of the hedge fund industry, the SRZ authors represent a broad range of practices and include investment management partners Stephanie Breslow, David Efron, David Nissenbaum, Paul Roth, Jennifer Dunn, Christopher Hilditch, Daniel Hunter and Jason Kaplan; investment management regulatory & compliance partners Marc Elovitz and Anna Maleva-Otto; employment & employee benefits partners Mark Brossman and David Cohen, and retired partner Holly Weiss; finance & derivatives partners Daniel Oshinsky and Craig Stein; mergers & acquisitions partners Ian Levin and Peter Halasz; and tax partners Philippe Benedict, Shlomo Twerski and David Griffel. The authors also received significant contributions from litigation attorney Betty Santangelo, special counsel Patrick Dundas and tax partner David Wermuth.

Published by Fastcase, Hedge Funds is available in both PDF and hard copy formats.
