NEW YORK (May 21, 2015) — In a feat unmatched in the legal industry, McDermott Will & Emery has been ranked for the sixth straight year as the nation’s only top-tier law firm in healthcare by Chambers USA, one of the most prestigious directory services for law firms.
In bestowing the honor, Chambers wrote that McDermott’s Health Industry Advisory Practice Group “continues to excel on the gamut of healthcare matters, including data protection, private equity and sub-acute care.” The Firm’s healthcare group was praised for its “impressive national footprint, enabling its representation of a wide-ranging client base.” Further, Chambers noted that McDermott’s “market-leading transactional expertise is complemented by notable regulatory and litigation strength.”
With this latest accolade, McDermott remains in the vanguard of the health law marketplace, where it has also received top honors from other elite legal directories, The Legal 500 USA and U.S. News—Best Lawyers, over the past five years. McDermott was also the past recipient of Chambers’ “Health Team of the Year” awards in 2010 and 2013, the only healthcare practice group to be so honored twice.
Clients interviewed by Chambers USA lauded McDermott’s Health practice, noting that, “It has the longest reputation in history as being the pinnacle healthcare firm.” Another client observed that, “McDermott has had an integrated model since time immemorial.”
“We’re delighted once again to be the recipient of this highly prized honor,” said Stephen W. Bernstein, partner and Global Head of McDermott’s Health Industry Advisory Practice. “This award is especially meaningful to us because it stems directly from client feedback. As such, it is a tribute to the skills, hard work and dedication of the attorneys in our Health practice: truly the best of the best in the industry. We thank our clients and peers for this tremendous recognition.”
In addition to its Band 1 status in the national healthcare category, McDermott received Band 1 rankings in the healthcare category at the state level for its practices in California, the District of Columbia, Florida, Illinois and Massachusetts.
Chambers USA identified several McDermott partners as “notable practitioners” at the national level. Firm partners in this group include Joel Michaels, Ira Coleman, Gary Scott Davis, Bernadette Broccolo, Michael Peregrine, Michael Anthony, Christopher Jedrey, Eric Gordon, and Practice Group Leader, Stephen Bernstein. At the state level, Chambers named 26 Firm partners among its top health law practitioners. McDermott leads all other nationally ranked law firm health practices in the number of ranked lawyers.
With an over 30-year history of serving the health care industry, McDermott Will & Emery has one of the most prestigious health law practice groups in the world. The Firm’s international health team, resident in its Boston, Chicago, Los Angeles, Miami, Munich, New York, Rome, Silicon Valley and Washington, D.C. offices, counsels leading organizations in every major sector of the health and life sciences industry on regulatory and business transaction issues. For the fifth consecutive year (2010-2014), McDermott’s Health Industry Advisory practice achieved a standalone, Tier 1 national ranking in Chambers USA’s healthcare category.

The end of January saw two significant developments for insider trading law stemming from the Second Circuit’s important decision in U.S. v. Newman, 773 F.3d 438 (2d Cir.2014). First, the government was dealt a significant loss when, on Jan. 22, 2015, U.S. District Judge Andrew L. Carter, Jr. vacated four insider trading defendants’ guilty pleas in the wake of Newman and rejected the government’s argument that the Newman decision does not apply to cases prosecuted under the so-called “misappropriation” theory of insider trading liability. Second, the next day, the government filed a petition for panel rehearing and rehearing en banc in Newman, seeking reversal of the Second Circuit’s earlier decision vacating the convictions of defendants Todd Newman and Anthony Chiasson and dismissing their indictments with prejudice. In this article, SRZ partners Harry S. Davis, Gary Stein, David K. Momborquette, Martin L. Perschetz, Howard Schiffman, Marc E. Elovitz, Eric A. Bensky, Peter H. White and former SRZ lawyers Barry A. Bohrer and Francis A. Marsico discuss these developments, which make clear that Newman is, as the government states in its petition for rehearing, “one of the most significant developments in insider trading law in a generation.”

Stephen Kranz and Diann Smith assessed two upcoming Supreme Court state and local tax cases, Direct Marketing Association (DMA) v. Brohl and Comptroller of the Treasury v. Wynne. Mr. Kranz said DMA “is focused on application of the TIA [Tax Injunction Act],” which “will have relevance to whether similar state legislation can be challenged in federal court — and that’s something that all of us will be interested in.” Ms. Smith added that Wynne “has the risk of fundamentally changing the way we think of — at the very least — how personal income tax laws are administered if the court sides with the state in this case. I can’t imagine that will happen.”

McDermott’s 250-person-strong tax practice was recognized as a “Tax Group of the Year” for handling complex deals and litigation. “Tax is anything but an afterthought here. We have the firm’s full backing and … support to do what we need to develop our clients,” state and local tax practice leader Jane Wells May said, while U.S. and international tax practice head Lowell Yoder agreed that “clients come to McDermott for tax and then stay for other services. Our clients recognize they’re getting the most sophisticated, thoughtful and careful thinking,” Work by Robin Greenhouse and William Goldman on a groundbreaking First Circuit ruling for a global pharma company was cited as an example.

Schulte Roth & Zabel attorneys have collaborated to update and expand Insider Trading Law and Compliance Answer Book 2015, a book published by Practising Law Institute. This easy-to-use, comprehensive treatise offers an explanation of both the basics and complexities of insider trading law.
Written in a clear, succinct question-and-answer format, this new edition fully integrates recent regulatory changes and provides a step-by-step understanding of the legal requirements imposed upon all investors. Insider Trading Law and Compliance Answer Book 2015 walks readers through the elements of an insider trading claim, what is legitimate company research that can be freely acted upon and what is nonpublic information that may not, when acting on a “tip” can incur legal liability, and the framework of civil and criminal penalties when insider trading has been successfully proved. In addition, new and expanded topics for the 2015 edition include discussions of scienter requirements for violations, the mosaic theory, and transactions involving foreign purchasers, exchanges or issuers.
Insider Trading Law and Compliance Answer Book 2015 serves as a reference for corporate insiders, investment advisers, compliance personnel, and both sophisticated and lay investors, as well as for the attorneys who advise and represent them.
