This panel discussion (hosted over Zoom) focused on what plans should do now in response to the Employee Benefits Security Administration’s (EBSA) Missing Participant Guidance.

With enforcement actions totaling billions of dollars, EBSA’s work on behalf of terminated vested participants continues to gain steam. New guidance issued by EBSA in January 2021 describes the agency’s compliance expectations in this challenging area. Our panel of experts discussed what plan sponsors, administrators and record keepers should do now about missing participants.

When a ransomware attack hits, it can be crippling to a company. With a clear understanding of the issues and advance preparation, however, attorneys can make the experience less painful for their clients. This program helps attorneys and businesses proactively prepare for an attack, and identify the “dos and don’ts” when responding to an attack. Finally, the program will explore best practices for data continuity or data loss prevention policies as well as discuss the legal risks of acquiring bitcoin wallets and paying ransoms.

This program will benefit lawyers whose job it is to help plan for and respond to ransomware attacks, as well as general counsel and other business attorneys who should understand how ransomware can impact their clients

    Learning Objectives:

    I. Describe the lifecycle of a typical ransomware attack

II. Examine policies and best practices that can help mitigate the risk of a ransomware attack

III. Identify the tools and technologies that can provide valuable insight into mitigating the risk of an attack, or investigating an attack that has occurred

IV. Discuss different ways a company can elect to respond to a ransomware attack

    V. Analyze the legal risks of making ransomware payments
