Kyle Faget co-authors AHLA briefing on compliance risks in physician consulting arrangements with life sciences companies

Kyle Faget co-authored an American Health Law Association briefing on structuring key opinion leader, advisory board, speaker program, and other physician consulting arrangements to withstand government scrutiny.

The authors review the federal laws that govern these arrangements, including the Anti-Kickback Statute, the Stark Law, and the Sunshine Act. They also cover recent OIG guidance and an unfavorable advisory opinion on royalty-based consulting payments, and the enforcement trends behind them, including DOJ’s use of data analytics and whistleblower-driven cases.
