Global law firm McDermott Will & Schulte secured a landmark victory for a former healthcare executive in In re Outpatient Medical Center Employee Antitrust Litigation pending in the US District Court for the Northern District of Illinois, where McDermott, along with several law firms representing other defendants, successfully defended against class certification in one of the most significant labor antitrust class actions in the country.

The ruling marks the latest success in McDermott’s long-running involvement in the matter, including a preceding criminal matter, where the firm previously helped secure a complete acquittal on all charges in the US Department of Justice’s first-ever criminal no-poach prosecution.

The team was recognized in Law.com’s Litigator of the Week Colum for this matter here.

In a 48-page opinion, the Court rejected plaintiffs’ motion to certify a class of more than 6,000 employees and excluded key portions of plaintiffs’ expert testimony. This result is particularly significant as the Court rejected plaintiffs’ certification framework in its entirety, excluding plaintiffs’ experts in employee compensation and labor economics and denying plaintiffs’ challenges to all four defense experts.

The McDermott team was led by partners Daniel Campbell and Jeffrey Stone, with invaluable support from Chelsea Mounayer, Gabrielle Siroonian, and Emma Goodman-Fish. The team was aided by co-counsel from Morgan, Lewis & Bockius, McGuireWoods, King & Spalding, and Wilson Sonsini Goodrich & Rosati.
