Starting in October 2025, the Centers for Medicare and Medicaid Services (CMS) will begin auditing and enforcing compliance with reporting requirements under Medicare, Medicaid, and SCHIP Extension Act (MMSEA) Section 111. MMSEA 111 requires reporting of information to Medicare to prevent Medicare from paying for Medicare claims that are the financial responsibility of another party. The universe of entities with MMSEA 111 reporting obligations includes virtually all entities that may have financial responsibility for the medical costs of a Medicare beneficiary, including liability insurers, group health plans, workers compensation plans, health care providers. Penalties for non-compliance include Civil Monetary Penalties and False Claims Act liability.
