In a recent Law360 article by Marialuisa Taddia, Schulte Roth & Zabel partner Polly O’Brien discussed rising interest rates and the impact they may have on litigation funding.

According to Polly, the potential for high returns in investments which are not linked to broader market movements has benefited litigation funders while interest rates stayed low.

Now that interest rates are rising, Polly says “opportunities for those funds in asset classes that are more familiar to them may be priced more attractively than they were before, even if not as attractive as litigation funding.”
