International law firm McDermott Will & Emery is pleased to announce the release of a major new study that provides a roadmap for structuring and navigating a cyber volunteer force to strengthen critical security assistance nationwide. Creating a Cyber Volunteer Force: Strategy and Options (the Cyber Volunteer Study), completed as a pro bono project by McDermott for the public benefit, has the potential to help reshape the cyber volunteer landscape to get more resources to the frontlines of cyber defense.
While there is currently no national policy or task force on cyber volunteering, there is a recognized need for such an initiative given the ongoing threats to national security. Many small and rural critical infrastructure entities—the most vulnerable and exposed—lack cyber resilience and are unable to run mature information security programs or mount an effective incident response. Indeed, the Biden administration’s updated National Cybersecurity Strategy states: “We must rebalance the responsibility to defend cyberspace by shifting the burden for cybersecurity away from individuals, small businesses, and local governments, and onto the organizations that are most capable and best-positioned to reduce risks for all of us. . . Our rapidly evolving world demands a more intentional, more coordinated, and more well-resourced approach to cyber defense.”
The Cyber Volunteer Study notes there are over 750,000 open positions in the cyber security field, or a 40% deficit of such open positions. According to a Senate report, the “consistent shortage of cybersecurity personnel represents a high risk to national security.”
The Cyber Volunteer Study explains the current state of our nation’s disconnected and siloed cyber volunteer efforts, compares various cyber volunteer models and identifies best practices and the relevant legal issues that should be considered and addressed. The study offers strategies for creating a more robust cyber volunteer initiative that backstops major national players who have the necessary resources.
“The need for a cyber volunteer force is a national imperative without a national solution,” said Mark Schreiber, lead author of the Cyber Volunteer Study and Counsel at McDermott who focuses his practice on cybersecurity and privacy. “This requires a strategy, resources and national attention to coordinate robust volunteer efforts nationwide, and this study helps provide that roadmap.”
The US Department of Homeland Security’s Cybersecurity & Infrastructure Security Agency (CISA) has developed an extraordinary number of detailed programs and initiatives. Yet, many small and rural entities do not have the personnel to implement those programs. The Cyber Volunteer Study assesses current and potential models to integrate volunteers to address this critical need for skilled cyber assistance. Cyber volunteers come from various diverse sources, including security and forensic companies, post-military services, universities and some newly skilled individuals wanting to help.

McDermott Represents US Conference of Mayors in Fight to Preserve Local Governments’ Ability to Address Gun Violence in Their Communities
PRESS RELEASE
January 30, 2023
Read time: 4 min
International law firm McDermott Will & Emery, along with lawyers at the Institute for Constitutional Advocacy & Protection at Georgetown University Law Center, filed an amicus brief on behalf of the United States Conference of Mayors (USCM) in National Association for Gun Rights and Susan Goldman v. City of Highland Park, Illinois, in the US District Court for the Northern District of Illinois. The brief supports the city of Highland Park as it works to maintain the legal flexibility necessary to regulate access to assault-style weapons and high-capacity magazines that lead to mass shootings and political violence.
USCM argues in its brief that addressing the increase in mass shootings and political violence requires regulatory flexibility, specifically for local governments, which are impacted uniquely by these events. In New York State Rifle & Pistol Association v. Bruen, the Supreme Court of the United States recognized the need for local governments to be able to innovate to protect their constituents, and the Court preserved flexibility for cities and states to regulate new and dangerous weapons. The brief explains that without this regulatory flexibility, local governments will be paralyzed in the face of a growing epidemic of gun violence.
“The legal issues in this case underscore societal safety issues at play for local governments across the United States—something that directly impacted the city of Highland Park on July 4, 2022,” said Jeffrey Stone, litigation partner and chairman emeritus at McDermott. “We are proud of the significant work put forward on this important issue on behalf of USCM.”

McDermott Celebrates 40 Years of Excellence in Boston
AWARDS & RANKINGS
November 8, 2021
Read time: 5 min
International law firm McDermott Will & Emery first opened its doors in Boston on October 1, 1981.
This year marks 40 years of excellence in our dedication to the legal practice in Boston and adopting our core values—innovation, teamwork, diversity, serving the community and #AlwaysBetter—as part of our everyday work.
Harvey Freishtat, founding partner of the Boston office and former Firm chair, reminisced: “What I liked most about being part of the McDermott team in Boston, particularly in those initial years, was a feeling that we were building something very special—with the help of a very large firm—and that we were all in it together. Every voice mattered, each of us mattered, and that’s what I think gave us the very special flavor and culture to be able to grow as well as we did.”
The Boston office’s culture has often been attributed to Harvey’s leadership, laying a foundation that fosters inclusivity, growth and great success.
Today, Boston is led by Office Managing Partner Ed Zacharias. “At McDermott, we celebrate hard work and excellence; we emphasize happiness and encourage a rich, full life in- and outside the office. It’s all part of our #AlwaysBetter mantra, as we strive to bring our best to our clients and to each other every day,” Ed said. “At our core, the fundamental values that were in place when I started 15 years ago still remain, and I think that’s why people stay.”
Since opening, McDermott has been through three office moves and grown significantly in size. In January 2020, the Boston office relocated to 200 Clarendon Street, the former John Hancock Tower. This location spans Floors 57 and 58 with unobstructed views throughout, reflecting our vibrant, high-energy and transparent culture while also supporting evolving needs and a flexible work environment.
Firm practice groups represented in Boston include Healthcare, Intellectual Property (IP Litigation and IP and Patent Trademark Services), Litigation (White-Collar & Securities and Trial), Regulatory (Privacy & Cybersecurity and Alcohol and Distribution), Tax (Employee Benefits + Executive Compensation, State & Local Tax and US & International Tax) and Transactions (Corporate and Energy).
Our Boston lawyers are some of the leading practitioners in their respective fields. In Chambers USA’s 2021 rankings, 11 Boston-based partners were recognized and notably six partners were ranked Band 1. McDermott is the only firm to have an elite ranking for its healthcare practice, again earning Band 1 in USA – Nationwide Healthcare. Also top-ranked is our white-collar practice (Band 1) in Massachusetts.
Pro Bono
McDermott’s Boston office has been at the forefront of the Firm’s robust pro bono initiatives. Through 134,000 pro bono hours, we have provided legal counsel, support and funds to many local and national organizations, including:
- American Heart Association
- Greater Boston Food Bank
- Greater Boston Legal Services (GBLS)
- Milagros para Niños
- Political Asylum Immigration Representation Program
- Silver Linings Mentoring
- Youth Villages
In August, the Boston office received GBLS’ Associates Drive Innovator Award for its creative fundraising strategies in the 2021 Drive, having raised over $11,000 for domestic violence survivors.
“The Boston team is all in, and you feel that—from our staff professionals to our partners. Being part of a team that is really empowered to do their best work makes everyone want to show up and give it their all every day,” Linda Mangini, chief of administration, said.
