Katharine O’Connor and Gregory Heltzer wrote, in an Antitrust Alert cited here, that the FTC “will continue to investigate and pursue trade associations and professional guilds for rules and guidelines that encourage or require members to limit competition with one another” Thus, the lawyers concluded, associations and guilds “should be cautious” of any actions by which members “may be seen to be sharing or agreeing to any pricing.”
