David (Dave) Kiefer focuses his practice on litigation and arbitration matters arising out of construction and energy disputes over large, international infrastructure projects, including megaprojects valued in the billions of dollars.  He is widely recognized for his depth of experience and knowledge of the technical and commercial aspects of construction projects, as well as his advocacy skills.  Respondents reporting to Chambers USA (2026) note that Dave is “a master of his domain in construction litigation and arbitration,” brings “pragmatic commercial sense” and is “fantastic at cross-examination.”

  • Represented an owner of a $10 billion dollar LNG export facility in two ICC arbitrations against an EPC contractor over the design and construction of the facility. Advised owner pre-arbitration on issues related to schedule, cost overruns and productivity
  • Representing an Italian multinational contractor and its Russian subsidiary in an ICC arbitration over claims of wrongful termination arising out of the design and construction of a fertilizer plant in Russia
