Tony Maida and Michael Peregrine wrote this bylined article on the implications of the Sacred Heart case, which involved individual executive prosecutions under the federal Anti-Kickback Statute. “The Sacred Heart verdict arose out of extraordinary facts, and on its own does not reflect a new emphasis on criminal prosecution,” the authors wrote, but they added that it does show that “the government’s focus on personal accountability for corporate malfeasance is real” and involves “several enforcement mechanisms [to] … pursue health care executives.”
