The authors analyzed the many uncertainties that arise in a bankruptcy situation, including for the debtor, and provide ways to mitigate the risks – adding in conclusion that “given the discrepancies in recent court decisions and the ever-changing landscape, a licensor or licensee seeking bankruptcy protection should carefully consider the jurisdiction in which it files.”
