The authors wrote that under these policies, “The Affordable Care Act and the antitrust laws are fully aligned in promoting … the principles of market competition,” meaning the ACA is not “a green light for anti-competitive consolidation and conduct among health care market participants.” The authors thus urged such participants to analyze every consolidation “under the traditional framework of antitrust law.”
